WHAT IS AN APOSTILLE and when you need it?

APOSTILLE is a certificate issued by the competent authorities of a State signatory to the Hague Convention for the official documents issued in that country, which will be presented to the authorities of another State party to the Hague Convention.

WHEN DO I NEED AN APOSTILLE?

When you need to use abroad official documents issued in Romania (for example, a marriage certificate, a power-of-attorney signed in front of a notary, a study certificate, an academic transcript, a certificate of criminal record, a divorce decree, a Court clerk certificate etc.). APOSTILLE is affixed ONLY for the countries that are signatories to the Hague Convention, unless between Romania and that country it is not signed a treaty/agreement providing an exemption from APOSTILLE. In practice, for certain countries, even if Romania has signed an agreement or a bilateral treaty providing the exemption of APOSTILLE, this is nevertheless required.

APOSTILLE is a certificate attesting that the document subject to this procedure is an official document, the authenticity of the signature, the capacity in which the public clerk has acted or, as appropriate, and the identity of the seal and of the stamp which it bears.

The procedure of affixing an APOSTILLE to the official documents - also called Apostillation - is made only for the countries signatories of the Hague Convention of 5 October 1961, and for the official documents to be used in countries that have not acceded to the Convention, the procedure of Consular legalization shall apply.

Before affixing an APOSTILLE, some documents must satisfy certain conditions (such as the certification of the study documents by the Romanian Ministry of Education). Please contact us for details.
